Disclosure of information - HSE Policy concerning pre-inquest disclosure

HSE has a restrictive policy in this area.

As is described below, the HSE will not allow a coroner to disclose any information that the HSE has provided to the coroner without the express consent of the HSE. In determining whether to allow disclosure the HSE will determine whether or not disclosure would prejudice criminal proceedings. In practice, the HSE rarely allows disclosure.

In December 2004, the CCA sought legal advice in relation to HSE's policy and this states that HSE's current policy is unsustainable and not supported by law. This is discussed below as well.
